PETITION TO THE HOUSE OF COMMONS

WHEREAS: Vincent Li brutally murdered Tim McLean in July 2008;

WHEREAS: Vincent Li was found Not Criminally Responsible on Account of a Mental Disorder for the murder of Tim McLean;

WHEREAS: offenders who are found Not Criminally Responsible on Account of a Mental Disorder may be detained in treatment facilities and not prisons;

WHEREAS: offenders found guilty of first degree murder are sentenced to life in prison without parole for twenty-five years and those found guilty of second degree murder are sentenced to life without parole for a minimum of ten years;

WHEREAS: there is no minimum period of detention for offenders found Not Criminally Responsible on Account of a Mental Disorder and their cases may be reviewed every year by a Review Board Committee.

We, the undersigned, citizens of Canada call upon the House of Commons

To amend the Criminal Code of Canada to ensure those who commit murder but are found Not Criminally Responsible on Account of a Mental Disorder are detained for a minimum period of time.

    This system is so badly damaged it’s unbelievable. In the Coquitlam Forensic institute recently Allen Schoenberg was granted supervised outings for coffee and such. This after he was found NCR of killing his 3 children. It has since been revoked but this is the same institute Kenneth Barter, the man who killed my brother, Nathan Mayrhofer, is and my family is terrified he will be granted some such atrocity also. I am writing to my provincial government to change the laws in BC and will also write to the Federal government. It cannot be allowed to happen!

    As of May 30, 2011, there is a hearing for Vince Weiguen Li who killed Tim Mclean to actually be released. This means the suffering of the victim’s family continues like pouring more salt into an open wound.

    This is exactly what is wrong with our legal system. I have never been close to experiencing what Carol DeDelly and Tim Mclean Sr have had to experience and a horrified nation over those graphic details. I have never met these people but I have empathy for their suffering. I wonder why a medical panel, a judicial panel or anyone in their right mind would consider his release as a good thing.

    What turns my stomach is the fact that this man could be released. So no feelings for the family of the victim.

    I really don’t care if he is saner than everyone in Canada. He took a life. I suggest if the judge feels safe releasing him, perhaps his relatives need to be slaughtered for him to understand why it’s a bad idea.

    I hate Canada for it’s blizzards and bitter winter that makes me think spring will never come back. I hate this country even more for it’s idiotic policies that allow the killer to be set free.

    If he is set free, the judge should be held accountable for Mr. Li’s actions thereafter. This system we have is very broken and will not get better until it gets worse.

    Our Canadian system is so broken when it comes to the mental illness aspects of crime. I am sorry but if you do the crime you do the time. No if’s and but’s about it. I do not care if it is because of alcohol fueled rage or drug induced psychotic event.

    What and who is to keep this nut on his meds? Who is to say he will not do it again? It is absolutely absurd to ignore the crime here. He killed, mutilated and ate a human being that was dear to many here.

    I am sure that the witnesses to thi scrime would eat their own arms off just to get those images out of their head and to stop the screaming when they try to sleep at night.

    Justice was not served here at all. I am ashamed of our system and how it treated the victims with no justice. Sign the petition!

    I agree with everything Tim’s mom had to say. Vince Li should remain in custody to ensure he takes his medication for the same period of time that a person convicted of 1st degree murder. There is no cure for his illness.

    I am appalled and disgusted that victims of crime continue to be victimized by the criminal justice system. Where is the victim’s justice system? There is not a shred of hope, nor any assurance whatsoever, that we can be confident that Vincent Li would not slide back into his old ways, not taking medication, were he to be released, “integrated” back into society. That makes all of us potential new victims, with this sword of Damocles hanging over all of our heads. He may not be an official murderer…but he is a killer, and should remain in locked custody.

    Anyone who commits a murder whether they were mentally ill, or knowning did not take medication, should give up their life (freedom) as a result. They should be put in an institution for life with no chance of release. I am sorry if they were mentally ill enough to take a life, society cannot depend on them to self medicate or take the chance they will go back to a mentally unstable condition.

    I understand that mentally ill persons that kill, need to be treated and housed in something other than a penitentiary, but their rights must stop being held to a higher level than that of victims, their families and the general public. If Vincent Li is ever released, will there be somebody there to watch him take his “meds” every day. When the mentally ill “feel better” there is a tendency to say I don’t need them any more and they stop taking them. I do not ever ever want to see another family go through this again. Sadly, people like Vincent Li and others like him, who commit heinous crimes should be locked away from society to protect all of us.

    We must improve our laws/change them were & when its needed. He may not be mentally responsible but he is capable.
    Would the lawyers and the people who are responsible to release these killers feel comfortable knowing that there family members may be in contact with them IE in the same elevator, standing in line with them in a restaurant, sitting in a waiting room with them knowing full well they cant guaranty beyond a reasonable doubt, witch by the way is needed to convict someone so why not use the same terms to release them, that they will not commit a similar act again I doubt it!!!!

    I am appalled at the thought that this individual, Vince Li, will eventually be released into our society without supervision, without us knowing his whereabouts, without knowing if indeed he is taking his medications which otherwise might bring on the same metal condition.
    I also agree that Vince Li should remain in a locked-up institute. To my understanding he was not convicted as murderer because of a Mental Disorder… but he is a killer. If he is eventually found to be stable enough to be integrated back into society then he should also be able to stand trial for his crime.
    When is the law-society going to start protecting us?

    I live in the town where he is being ‘treated’ and I do not want him to be out on day passes where he may come in contact with my children. He went off his meds before, what’s to stop him from going off them again if he is out of medical care. I don’t believe his freedom is warranted given the tragedy that has already occured.

    This man needs to be kept in a place where it is ensured that he is taking his medication daily. If not another killing will take place as soon as he feels well enough to quit taking his medications. Then who do we blame? Tim no. Canadian govt. oh yeah.

    I live in alberta and remember hearing of this on our local news station when it occurred a couple of years ago. I was deeply distrubed by it and have been following it as the media covers it. Firstly I have to express my condolenses to Tim’s family. I was listening to the radio today and heard an interview with his mother and was brought to tears several times. I cannot begin to understand what she must be going through. To know her son is dead and never coming back and then to know his killer is now going through the motions of becoming a free citizen makes me sick. I cannot understand how we live in such a great country but our “justice” system fails the victims all the time. I understand that his killer was found not criminally responsible and he does in fact have a medical condition which requires him to take his medications, but as she said on the radio, he was the one who decided not to take his prescribed meds and killed her son. Now the killer is medicated again and making progress so they feel that he can have more freedom. Eventually they will release him and he will be a member of society again, until the next time he figures that he doesn’t need to take his meds anymore and strikes again. Pure BS. I think that we as canadians really have to rally our government and get some laws changed.

    My experience with working with individuals with mental health issues has been that unless strictly supervised, they will go off their meds. They either feel “much better” and don’t think they need them anymore or the medications have side-effects that they don’t like. For the most part, individuals with a mental health issue are more dangerous to themselves than the general public. Having said that, extreme cases like Lim Schoenberg et al should NEVER be set free. It’s too risky and dangerous!

    My prayers are with Tim’s family. It’s time for the laws to get tougher. Tim’s killer needs constant supervision to assure he takes his medications and never hurts anyone again. No family should have to go through what Tim’s family is.

    We can only hope that this action alerts our politicians to make change in our Criminal Justice System. To think that this man could one day be free frightens me.

    It would be very interesting to see how fast the laws would change if someone in the government had a family member murdered, by someone “not criminally responsible”…something wrong with the laws when if you are deemed insane, you seem to be able to do anything and get away with it. Does anyone look at the stats of these “not criminally responsible” people offending again once they are sent back into the community. I sure hope this petition helps to change the laws. My dear friend, Karl Alkier is now gone forever, he doesn’t get another chance….

    If Vince Li is improving to the point that he could become sufficiently fit for escorted leaves from the hospital. Then Vince Li should be escorted to the Federal Prison and remain in custody for life with no chance of release. Murder is murder and they should pay for their crimes keep the killer locked up and locked away from society to protect us all.

    I am a 41 year old woman, I am Bi-Polar, does that mean I can get away with killing and then *gag* eating someones child??!!!! Using mental health illness as an excuse not to hold him responsible (Mr.Li) is just that, an excuse. He was “sane” enough to pack, buy a ticket, leave his wife a note but because he said “god told me to” he is treated like the victim, I think not! Many serial killers have said they heard voices, or dogs talking to them, whatever, until Canadians start insisting on reform within the courts animals like this will get away with murder, literally! My last comment is in regards to the actions of the RCMP, to say that Tim was dead so that’s why they let this animal cut him up, eat his eyes and part of his heart is DISGUSTING, if it had been one of their sons that was being disemboweled you can be damn sure they would have shot his ass!

    I applaud you for allowing us to help with this battle. Too many criminals are using the “mentally unstable” route to plead their cause. Lawyers are looking out for number one! There are president cases on the books but the Judges don’t want to be “too harsh” and our society is suffering because we have no backbone. I believe in a second chance when a criminal has earned it and shown a genuine remorse. Not these mamby pamby cases. What about the survivors, where are their rights?

    Yes. Who is the victim here? The trouble with Canada (and probably lots of other places) is that the bleeding hearts prevail; those who think nobody can do any wrong.     I think it is disgusting how Tim has not received justice. I actually know of people who side with Mr. Li, and defend him to the end, because he was mentally ill and therefore not “criminally responsible”. I think this is reprehensible. I have mental health issues. I have experienced hallucinations before (not from schizophrenia, but from a possible sleep disorder). I know how very real they feel. But I also knew that the stuff I was hearing and seeing was illogical. And I got help asap, was put on medication, and am pretty much rid of those hallucinations. I always discussed my meds with my doctor and pharmacist and used their advice re: dosage adjustment, etc. It would have been irresponsible for me to not get treatment. I knew it could get worse, so I got help. Mr. Li,on the other hand did not take his medications properly, and allegedly refused treatment for schizophrenia in 2005. These things make him criminally responsible in my mind. Lock him up and throw away the key, I say.

    I am also mentally ill, but if I had done something as horrific as Mr. Li did, sick or not, I would belong in jail. With no chance of parole. Murder is always wrong! I don’t care what your claims are, if you are a violent criminal.

    Seriously, RCMP, wake up! The victim here is Tim McLean. Stop showing leniency towards his killer and start showing some compassion for Tim. Again, he is the victim, and the *only* victim here.

    I am writting to the Justice Minister, my MP and the supreme Court, to protect the Canadian tax payer from the bastardization of the legal sense of justice. Do away with this law in full and give the tax payer the right to expect TRUE JUSTICE for the crimes that are committed against us. I view ALL parts of the legal tread -mill (law schools, courts, lawyers, judges, DEFENCE -LAWYERS, Parliament, and the supreme court )as suspect in keeping this insane line of defence valid.     I agree with some comments that the legal system be held more responsible for releasing pysco related criminals. If they are released they should have to have an accountable contact for life and have a record so police may be beable to act more swiftly in some situations etc
