PETITION TO THE HOUSE OF COMMONS

WHEREAS: Vincent Li brutally murdered Tim McLean in July 2008;

WHEREAS: Vincent Li was found Not Criminally Responsible on Account of a Mental Disorder for the murder of Tim McLean;

WHEREAS: offenders who are found Not Criminally Responsible on Account of a Mental Disorder may be detained in treatment facilities and not prisons;

WHEREAS: offenders found guilty of first degree murder are sentenced to life in prison without parole for twenty-five years and those found guilty of second degree murder are sentenced to life without parole for a minimum of ten years;

WHEREAS: there is no minimum period of detention for offenders found Not Criminally Responsible on Account of a Mental Disorder and their cases may be reviewed every year by a Review Board Committee.

We, the undersigned, citizens of Canada call upon the House of Commons

To amend the Criminal Code of Canada to ensure those who commit murder but are found Not Criminally Responsible on Account of a Mental Disorder are detained for a minimum period of time.

    Yes, mental illness is a sickness but when it causes someone to violently torture and kill another human being or animal then it’s time to change the laws! Vincent Li should have been held criminally responsible by reason of insanity. In this case the death penalty should be brought back to Canada. When an animal is rabid they put that animal to death, it should be the same with Vincent Li.

    There are no words to describe the horror of this crime. For no one to be held responsible is a crime in it’s self.
    We need to fix the system that allows these monsters to rejoin society as if nothing has happened. If the Canadian Justice System refuses to recognize the problem then we, as the possible victims, have to take it upon ourselves to force this change. Call your local members of parliament and strongly demand an immediate restructuring of the criminal code to make sure these guilty, mentally ill killers are never set free again.

  6. The victims of this kind of crime have no rights, but the purps have all rights and access to everything. Yes they need help mentally but should not be released back into society after brutally killing innocent people like this.

    Enough is enough!!! Justice for victims, not for criminals. Jail time or mental institutions – they should not be on the street threatening the society including safety of our children.     How easy is it to fabricate insanity?
    How many defense lawyers advise their clients to act insane.
    Why do defense lawyer’s solicit for payment a psychiatrist, usually a social buddy, when the Crown subpoenas the provincial psychiatrist, who is on salary? Many times their testimony is contradictory!

    Our justice system is lopsided in that high profile lawyers could probably be in hollywood because of their ability to sway a jury, particularily when the ‘buddy’ system works in their favor.

    Lee should not be released into the community. Should have been sentenced to a life sentence in a mental institution.

    Politicians need to be more accountable to the victims which include family and friends.

    I don’t think the issue here is the legitimacy of the “not criminally responsible due to mental disorder” condition, but rather what happens to individuals who receive this label after they are released by the courts into psychiatric facilities. I’m sorry, but if someone is capable of committing a heinous crime like the greyhound butchering without being culpable then what is preventing this person from doing it again? Medication and treatment? If it were that simple I doubt the crime would have been committed in the first place. The irony of the view held by many “professionals” within the pssychiatric community that because individuals with severe mental illness cannot be held criminally responsible, and therefore eligible to serve time in prison, for their crimes, due to mental incapcity, is that these individuals are arguably more dangerous and in greater need of being contained for the very reasons they are found not responsible in the first place–they were’t in control of their actions when they committed the crime.

    Seems to me our Justice System is harder on money crimes than they are for crimes of MURDER….it is just so wrong.

  26. To allow this man to attend public places under any condition is unbelievable. We have a family friend who was waiting in the parking lot while her father shopped and was terrified when a van pulled up and Li alighted in shackles and with two escorts. No one in a public place should have to deal with this trauma….let alone where CHILDREN are! This man is a murderer…if he is well on his meds in a controlled environment, good for him.     Our Canadian Laws are so week, especially when it comes to murder. This also refers to 1st and 2nd degree murder in Canada. The saying goes here in Canada that you can “get away with murder”…..literally! This brutal murder in front of innocent bystanders was so sick and so uncalled for. A young man’s life was taken for no reason other than this guy heard voices! Well, if he heard voices and responded to these voices, should he not have been in an institution already? Was he not seeing a psychiatrist prior to this senseless murder? Maybe it’s time doctor’s are also held accountable, especially in this case!? I say we change the laws for all murderers such as this creature! Change the laws so we never get to see him out on the streets ever again! What if he reoffends? If he reoffends again, who will be responsible, the voices in his head? I say the courts should be held responsible as well as the doctors who so freely gave him his freedom! Put him away for good or better yet, this case would have been a great case for capital punishment, just like all the other nut cases we have taking up space in our prisons! Canada and our justice system, if you want to reduce our expenses and taxes, begin using capital punishment for 1st and second degree murderers! If you don’t want to use capital punishment, then build more prisons with absolutely no amenities, like no tv, no entertainment, nothing. Make these prisons what they were intended for, jail time, not recreation centers behind bars!

      Very, very well said. I myself am going back to school for justice in hopes to get shit changed. Young offenders act included. Work from the inside and make a difference. I truly admire what you have said and 110% agree with you.

    Perhaps many offenders of this nature are not criminally responsible, but it is rare that no one is responsibile at all. It is irresponsible to NOT take your medications; it is irresponsible to NOT seek treatment when you have violent tendancies; it is irresponsible to release a mentally ill violent offender when it is possible they may at some time re-offend.

    What we need in Canada is a Charter where with each right comes a responsibility; you cannot have one without accepting the other without condition. Unfortunately there is no political will in this country to reopen our flawed Charter, so we get what we deserve.

    Reforming our laws to favour the rights of victims and the law-abiding ahead of criminals, judges and lawyers, and making responsibility mandatory, would give us a very powerful set of tools to make our society infinitely safer. Unfortunately, I don’t see Ottawa up to the task, as even the not-legally-responsible, and their families, vote, and their numbers appear to be increasing rapidly.

    It is becoming more apparent every day, with more and more examples that these so called experts are nothing more than quacks in Dr clothing. It is time we started charging these so called experts with criminal neglegance causing death each and every time they release on of these criminals back on the streets. AND THEY ARE CRIMINALS!!!! Because there is no cure and there is no way to gaurentee they will stay on their meds thus safe to be on the streets, the only solution to protect the public is to make sure they never be released.     I know a little of what Tim’s mom most being going thru. I lived thru the same horror and still do every year. My brother along with his room mate were killed in Fort St. John, B.C. eight years ago by a man who had been diagnosed as a paranoid schizophrenic. This person had been in trouble with the law previously for violent behavior and assault but always let go. While not taking his med’s he took my brother from me and the rest of my family for ever. He was found responsible for the murders but was found not guilty by reason of insanity. And yes like Mr. Li he is granted a hearing every year to find out if he can be released back into society. I agree this person needs help but should I be paying for it with my tax dollars. And if so fine, but ensure me that he will remain were he can get this help. This person has been granted day passes but has failed to return on occasions in the passed. I hope that a bill will be passed that will help this person and ensure our safety.

    The first cop on the scene should have stopped the world and let it off. That would have saved us taxpayers a lot of money (this is, I think, the main reason for our revolving door policy in dealing with these AH’s). However there is no way this could or will happen, so it should be locked up forever.

    I am shocked at how quickly and without any thought to the victims or their families these people, who commit horrific murders of their children,other family members or total strangers are released back into society.It would seem that mental illness or more commonly, deciding to go off meds,is a justification for the most atrocious crimes. Once judged mentally incompetent,a period of psychiatric evaluation and treatment often as short as a year or so follows. Should the psychiatrists decide they,ve “got the patient back on the right track,off they go introduced back into society,with no consequence for past behaviour and no accountability placed on the “experts” if things don’t work out as planned.I think it is very reasonable to expect that these people be cared for humanely in an institutional setting and should not be placed back into society to possibly threaten other innocent victims.

    Just saw Tims mother on Sun News via Charles Adler and I had to come visit the site to give my support. I’m a Canadian citizen and I remember the horrific story of the murder. Now I have to keep the sick feeling inside my own stomach knowing that yet another no-good criminal is being released. Our world is so pathetic. How can we let these kinds of decisions go?? Who’s behind this BS? It’s an OUTRAGE! It’s NOT NORMAL! It should actually be a CRIME to let a CRIMINAL as sick at Li breathe another breath of our fresh air after such a sick crime. Way to embarrass our nation, those who deemed him “safe” for release. As if he’ll be supervised forever. What a farce. YOU PEOPLE SHOULD BE ASHAMED OF YOURSELVES! YOU MAKE ME SICK! Li deserves the death penalty for sure.

    The common sense and wishes of the overwhelming majority of the Canadian people are not being listened to and acted upon. Releasing mentally ill people convicted of extremely gruesome murders back into the community for even a one minute day pass on the say so of a psychiatrist who says they “should” be safe “if” they stay on their medication is another example of the system (that we pay for) not safeguarding us.

    Completely agree-the laws need to change. If Vince Lee is so sick he should never be allowed back on the streets again-There is no guarantee that he will continue his med’s.They never do.Until the day he dies-Vince will always hear voices in his head telling him to do something that normal people would never do.I am disappointed completely with our justice system.

    a 1% or less chance of reoffending?! No one can predict with that much accuracy on anything. What happens if he goes off his meds? My feeling is that if they are found NCR when they commit an atrocious crime & then are treated & regain “responsibility” they should go back to court for a trial & get sentenced accordingly to Canadian laws which are much too lax. But this would be an enormous endeavour finding politicians that would support it & having it go to Supreme Court which only has a “1%” chance of occurring.

Mental illness be damned…the man is not capable of being completely trustworthy to take his medication….who else must die at his hand for the “authorities” to take this seriously??????

    I do understand the reasoning behind mental insanity pleas,,,,sort of. Wouldn’t it be better served by Guilty by the Reason of Insanity. If someone was to commit a murder such as Tim’s (God rest his soul & bring his family peace)& got ‘cured’ apparently (supposedly), don’t you think that person (the one who committed murder) would understand why they are ‘doing time’? If they don’t understand, maybe they are not ‘cured’. Anybody in their right mind would understand that decapitating someone deserves quite a lot of punishment. So explain, if you can, why a murderer would think they can get away with murder if they’re in their right mind….they SHOULD be feeling guilt EVEN if they don’t remember it. I know if I found I killed someone while I was ‘out of it’, I would feel tremendous amounts of guilt & feel I deserved punishment.

He planned what he did that day by bringing that hunting knife and scissors with him. He knew he was about to murder someone. premeditated for 100%. He just didn’t know who his victim was going to be. Asshole, deport it back to it’s own country and let them deal with him. Canada don’t care who they let into our country, they just care about the money they bring in. It’s so sad how this country is going to hell because the government don’t know how to run it. Why didn’t they deport him, instead of keeping him here, having taxpayers pay for his trial and his living costs. He came to this country, He has to abide by the laws. There are many people with real mental illness and they don’t go around hurting people, even when they are off their meds. He knew what he was doing and enjoyed it and then used the Canadain laws to protect him by saying. He’s schizophrenic. And, the psychiatrist, now there’s another big joke. They think they know everything. what a laugh. They are the ones that make the desision that gets him off in the first place by deeming him not mentally responsible. Maybe if he came after one of them one night while they were sleeping, they’d change their minds pretty quick and beg to have him locked up forever. Yes, Canada has to change in so many ways and please start with Tim’s Law. That innocent young man should not have had to go through that terrible end at the hands of that sadistic killer. I feel so much hurt in my heart for what he went through and how his family is surviving without him. Rip Timothy, you are in good hands now and safe from all the bad people. He’ll get his punishment.

    this maniac needs to rot in solitary confinement to be driven insane with the thoughts and visions of what he has done. death would be to easy for his actions.
    Tim’s family does not deserve to be re-victimized if this maniac is let out. i can’t understand how anyone part of the justice system could comprehend that this maniac could be “cured” and once again walk among us. i definitely wouldn’t want to be his neighbour or live in the same community and i don’t think i’m alone there. Tim’s family never got to say goodbye, the least that can be done is that they never have to hear about this sick fucker again.
    if he is let out he will not be safe, someone will hunt him down and give him what he deserves.
